DISCLAIMER OF WARRANTIES
WAIVER OF LIABILITY
Purchaser understands, acknowledges and agrees that this product is sold AS IS by Traveling Tower, LLC and SmithWorks Outdoors, Inc., except for the following Part Replacement Policy, meaning there are no express, implied or other warranties – including implied warranty for particular purpose. USE AT YOUR OWN RISK. Purchaser understands given the nature of the use of this product, injuries or property damage can result in its use.
In NO EVENT will Seller be responsible or liable for any damage, or claims such as incidental, consequential, personal injury (including death), loss of income, medical costs and further no claims may be brought against Traveling Tower, LLC or SmithWorks Outdoors, Inc. more than one-year after date of sale. This waiver of liability extends to Third-Parties that may use or be injured by the use of the product
Some states may limit the scope and effect of this “Disclaimer of Warranties, AS IS Sale, Waiver of Liability,” and you may have certain rights under laws of various states regardless of this agreement. However, the intent of this agreement to give the terms as full and complete application as is legally permissible.
Further, any claims must be brought in the Court of the State of Minnesota and within the time period stated.
DO NOT purchase this product if you cannot accept these terms.
PART REPLACEMENT POLICY
As for the Part Replacement Policy, products manufactured and sold by Traveling Tower, LLC and SmithWorks Outdoors, Inc., Traveling Tower, LLC and SmithWorks Outdoors, Inc. will replace any part that is found defective in manufacturing and not caused by misuse of negligence of owner, or accident or failure to follow directions of use, if returned to Traveling Tower, LLC and SmithWorks Outdoors, Inc. within one year of date of sale, at Purchaser’s cost. If part is found by Traveling Tower, LLC and SmithWorks Outdoors, Inc. to be defective, replacement parts will be shipped to Purchaser. This replacement policy is only for parts, does not include labor to repair/replace the part/product and is only for a one-year period from date of sale.
